AREAS
General Litigation
We represent public entity and private sector clients in the defense of catastrophic injury and death cases, as well as in the defense of employment, harassment, and discrimination actions. Specific to our public entity practice, we defend against civil rights actions and general liability matters. Within this practice area, we represent municipalities, special districts, risk pooling entities, and other public agencies beginning at the claim investigation and advice and counsel stage, continuing through trial, and on appeal.
On the private sector side, we represent Fortune 300 companies in all aspects of litigation, including high-exposure personal injury matters, breach of contract, and whistleblower actions; we also provide advice and counsel. Just as with our public sector clients, our work begins at the claim investigation and advice and counsel stage and continues through trial and on appeal.
Police Civil Liability
The police team represents officers and municipalities in Civil Rights cases. The cases range from alleged free speech violations to officer-involved shootings. Our defense starts at the claims stage and continues through jury trial. We provide advice and counsel to departments regarding training and policy changes. We train police officers to minimize the potential for liability.
Transportation
We represent rail and busing clients throughout California, including the defense of claims involving catastrophic injury and death. On the rail side, we represent passenger and private freight rail clients in cases involving FELA, accidents at grade crossings, and employment-related and FRSA whistleblower matters. We also represent our rail and busing clients in investigations performed by Federal (NTSB) and State (CHP and local law enforcement) agencies. In December 2021, Mr. Castillo and Mr. Offill-Klein obtained a defense verdict in a federal wrongful death case [the decedent was a young woman who was struck and killed by a train] in San Francisco District Court in a case in which plaintiff’s counsel asked the jury in closing argument to award plaintiff $20 million in damages.
Employment Litigation
We represent employers in the defense of every type of employment litigation, including race, national origin, age, sex, medical leave, and disability discrimination; harassment, retaliation and whistleblower cases; wage and hour actions; and defamation and intentional infliction of emotional distress claims.
Employment Advice and Counsel
We counsel employers to be legally compliant to minimize their risk of liability while providing practical, cost-effective solutions. We provide advice and counsel on a wide variety of employment law matters, including personnel policies, employee handbooks, leaves of absences, reasonable accommodations, participation in the interactive process, and COVID-related issues. We also represent employers in the negotiation and preparation of their employment-related agreements, including separation, confidentiality, arbitration, and consulting agreements.
